Terms and conditions
Uniform Conditions for the Hospitality Industry
To ensure everything runs smoothly for both you and us, we have drawn up a number of terms and conditions. The “Uniform Conditions for the Hospitality Industry” (Uniforme Voorwaarden Horeca, UVH) apply to all of our services and take precedence. You can download them at www.khn.nl/uvh-nl, or we will send them to you free of charge on request. The UVH are binding for everyone who makes use of our services.
Below is an explanation of the most common terms.
Option/reservation
- Pesca places a provisional reservation (an option). This provisional reservation remains valid for a maximum of 14 days, unless otherwise agreed.
- The provisional reservation becomes definitive as soon as Pesca has received the deposit (see payment terms).
- Should Pesca receive another request for the date held under option, Pesca will contact you.
Number of guests
- Pesca takes the number of guests stated in the confirmation as the basis for the arrangement.
- The number of guests may be changed free of charge up to 5 working days before the reservation date, up to a maximum of 15% of the number stated in the confirmation.
- If the number of guests is reduced within 5 working days before the reservation date, the number known to Pesca will be charged.
- Any change to the number of guests must be communicated by the client by email.
- Increasing the number of guests is of course possible by arrangement, provided the space and layout allow for it. You will receive a new confirmation for this.
Payment terms
- The prices stated in the quotation are subject to annual price increases. If your reservation takes place in a following calendar year, prices will be indexed in January of that year in line with CPI (Consumer Price Index) indexation.
- Payments must be made by debit or credit card. Payment by invoice is only possible for business reservations exceeding € 500.00 and must be agreed in advance.
- For payment by invoice, Pesca applies a payment term of 30 days.
- For groups of 16 people or more, Pesca will send a request for a deposit of 50% of the quoted amount by invoice.
- If the deposit has not been received within 5 working days before the reservation date, Pesca reserves the right to cancel the reservation.
- After the event date, Pesca will send a digital invoice for the remaining balance.
- If Pesca needs to hire in additional materials, these will be charged directly to the client.
- Where an agreement is based on a minimum spend on food and drink and this amount is not reached on the day itself, Pesca will charge the shortfall on the final invoice. This difference is charged as a service fee, subject to 21% VAT.
Cancellation terms for hospitality services (in accordance with article 9.4.2 UVH)
Where a reservation has been made for a business group, the following applies to cancellation of that reservation:
- More than 6 months before the reserved time: 0%
- More than 3 months before the reserved time: 10%
- More than 2 months before the reserved time: 15%
- More than 1 month before the reserved time: 35%
- More than 14 days before the reserved time: 60%
- More than 7 days before the reserved time: 85%
- 7 days or fewer before the reserved time: 100%
Where a reservation has been made for a private group, the following applies to cancellation of that reservation:
- More than 14 days before the reservation date: 0%
- Between 14 and 7 days before the reservation date: 25%
- 7 days or fewer before the reservation date: 50%
- 3 days or fewer before the reservation date: 75%
In the event of a no-show or early departure of a guest, Pesca is entitled to charge the full amount for all booked food and beverages (F&B).
Force majeure
Pesca is released from any liability that may arise as a result of force majeure or shortcomings in the delivery of the service and the event on the agreed date for reasons that cannot be directly attributed to Pesca. Such circumstances may include, but are not limited to, force majeure, fire, explosions, flooding, and water, gas, or power outages, etc.
Damage, theft, or loss
- The client is liable for any damage to Pesca’s property caused by guests, and expressly authorises that the cost of any repairs or replacements in this regard is borne by the client.
- Pesca is not liable for loss of or damage to guests’ property or to materials hired in through third parties.
- If third parties fail to meet their obligation to deliver, for any reason whatsoever, Pesca is not liable for any resulting damages. The foregoing also applies in the event of a suspension, for any reason whatsoever, of supplies by public utility companies.
Décor and styling
- The client is responsible for their own décor and styling, including setup and breakdown.
- Attaching, drilling, or nailing materials is not permitted. In the event of damage to the premises, the repair costs will be charged (on the basis of actual costs incurred).
- The use of confetti or any other form of scatter material is not permitted. If confetti or other scatter material is used, Pesca is obliged to charge € 500 in cleaning costs. These cleaning costs will be included in the final invoice.
- Materials brought in by the client must be of fire-resistant quality, accompanied by a certificate of fire propagation class 1 or 2 (impregnated at the factory), or an impregnation certificate no older than four days. The fire brigade may carry out inspections during the event and may reject materials. This also applies to items such as lanterns, flags, and so on.
- Setup and breakdown times must be confirmed in writing by Pesca.
- Pesca is not liable for loss of or damage to décor and styling.
- If the standard setup is deviated from, Pesca will charge additional staffing costs for setup and breakdown at € 25 per hour per employee.
- Décor and other items must be taken away immediately after the event.
Permits, fire, music, and waste
- The client is responsible for applying for any permits required to hold an event. Any damage arising from such permits not being in order is at the client’s expense.
- The use of sound equipment or musicians must be confirmed in writing by Pesca. Sound levels of up to 85 dB are permitted. In the case of live music, sound levels are open to discussion. Any BUMA and/or STEMRA royalties must be paid by the client.
- The use of fire or fireworks is not permitted.
Table reservations
We make sure you can enjoy your table for at least 2 hours. After that, we may need the table for other guests.
